Hawaii is a state that accepts “joint applications.” ONLY ONE APPLICATION FOR TWO IDENTIFICATION NUMBERS (one for SIT and one for SUI).

Did you know that, even if the other state imposes withholding on the same earnings, Hawaii compels employers to deduct state income tax from the wages of residents working in other states?

Hawaii Wage and Hour Laws

Employers must pay employees covered by Hawaii’s minimum wage legislation at least $10.10 per hour, with tipped employees receiving $9.35 per hour.

Except for the following personnel, who are not covered:

  • Those who are covered by the federal minimum wage if it is higher than the state minimum wage
  • individuals who are paid a guaranteed $2,000 each month;
  • employees in the coffee picking industry;
  • Agricultural workers who work for a company with less than 20 employees;
  • individuals with legitimate executive, administrative, managerial, or professional responsibilities;

Hawaii Payroll for Employers

Wages must be paid at least twice a month and no later than seven days after the end of a pay period for employers subject to Hawaii’s wage payment legislation. Employers can opt for a monthly payment if the majority of employees in a collective bargaining unit do.

Hawaii Income Tax Withholding

Hawaii payroll taxes for employers are required to withhold state income tax from their workers’ pay and return the withheld amounts to the Department of Taxation.

For services done in Hawaii, any employer with one or more workers in Hawaii is required to withhold income tax from the earnings of both resident and nonresident employees. Residents may, however, get a credit for income taxes paid to another state against their Hawaii income tax.

Employers in Hawaii are required to provide employees with appropriate leave time to vote if certain requirements are met.

Temporary Disability Insurance

Employers who are covered must provide private or self-insurance disability insurance to their employees. Employee pay may be withheld up to half of the cost of premiums.

The temporary disability statute applies to companies in Hawaii that have one or more employees on any given day. Service performed for pay under any written or oral contract of hire, stated or implicit, is covered, as is service in interstate commerce. Agricultural work and overseas government duty are specifically covered under temporary disability insurance. Services for which temporary disability compensation is available under a government program, as well as commission-based real estate salespersons and brokers, are excluded from coverage.

Accidental damage, disease, infection, or illness is referred to as “injury or sickness.” Sickness refers to an employee’s entire incapacity to execute the tasks of her job due to pregnancy or termination.
